Terms & Conditions
- Elegant Stone Products INC. (ESP) Terms & Conditions (May 2022)
Quote/Estimate/Contract
(Payment may be handled through your selling partner. Please inquire with your salesperson.)
*This Quote/Estimate/Contract was prepared from drawings, square footage (sq/ft) and other information provided by the customer/partner at or near the time of sale. Final Quote/Estimate/Contract will be determined after template is completed. Quotes will be valid for 2 weeks. Holding material (Stock/Special Order) for longer than 2 weeks requires a 50% down payment.
*Any changes to this Quote/Estimate/Contract (i.e., stone color, edge profile, sink, changes in dimensions, new pieces, repairs to cabinets, number of holes drilled, supports, other on-site construction, etc...) must be made at or before template. Any cost differences will require an update Quote/Estimate/Contract.
* Method of payments include cash or check, (Checks must be made payable to: Elegant Stone Products)
*Credit/Debit Cards, accepted through Elegant Stone Products, with a 4% surcharge added to each transaction.
* Final payment due at or before installation. Late fees of 1.5% daily may be assessed through Elegant Stone Products.
*Hand selecting the specific slabs that will be used on your job adds a $200.00 charge to the Quote for the special handling required. This would be for complete A Frames of stone where there may be 6 to 8 slabs of the same color to go through.
*Non-Stock material is custom priced on a case-by-case basis. If changes are made (i.e., adding/removing pieces, increasing/decreasing dimensions, etc.) after the initial quote, it will change your price based on the updated information.
Prior to and at the time Template
*Approval for layouts and waiting for products can also impact install timeframes.
*Customer is responsible for clearing off all countertops prior to templating or template could be subjected to rescheduling and a $200.00 charge will be applied.
*All cabinets must be in place, level, and secure at the time of template. ESP is not responsible for leveling cabinets. NO MODIFICATIONS to cabinets should be made after template is completed to ensure proper fit and installation. Should cabinets not be properly installed at time of installation, a return trip charge of $200.00 will be assessed.
* Countertops will sit directly on top of the cabinets. Cabinets need to be flat and level. Cabinets need to be shimmed to ensure appliances such as slide-in ranges and dishwashers will fit per specifications. Cabinet condition is the responsibility of the homeowner/contractor. In some cases, to install countertops properly, countertops need to be shimmed to level. Additional costs may occur for shimming more than 1/4”. If shimming is not required, countertops will be installed in plane with cabinets.
* Apron/Farm sinks must be in place in the cabinetry prior to template by the homeowner or contractor. This is important so that the technician can shoot the laser around the sink to insure the stone fits.
*Cabinets not being set, and apron/farm sinks not being secured will result in the need to reschedule for another template which will result in an additional $200.00 charge plus mileage.
*The Decision Maker is required to be on premise during template to make final decisions and answer any questions that might arise. Not having the Decision Maker on site could result in the job being delayed.
* If no one is on-site for template, standard choices will be made where options are available. These standard options are standard corners based on edge profile and 2.5” inside radius, overhangs of 1” and/or 1.5” where there is no seating (seating area will be based on quoted measurements), and sink reveals based on style of sink and known accessories such as cutting boards.
*Customer provided sink and faucets must be available not later than the template date so that information can be added to the job details for fabrication. These items not being available will likely hold up the fabrication and installation of the job.
* After the time of template, we will confirm any deviations from the original quote/drawing. Any deviation or alteration from the original specifications involving extra material and/or labor will be an extra charge and a new estimate will be provided to the customer before fabrication can begin. Up to a 30% restocking fee will apply to cancelled jobs.
Prior to and at the time of Installation
*The Decision Maker needs to be onsite during installation to sign off that they are COMPLETELY SATISFIED prior to the installation team leaving the jobsite.
*ESP prefers all appliances to be out of the installation area prior to install. All pertinent appliances and fixtures, including but not limited to, faucet assembly, stove, etc. must be present for verification of proper fit or a return charge of $200.00 will be assessed. ESP will not be held responsible for any damages resulting in the moving of appliances.
* If customer is reusing any existing material such as sinks, tile, or countertops, ESP IS NOT responsible for any damage that may occur during the removal process.
* If cabinets are not level, shimming may be required to level the countertop. Any trim work required due to shims is the customer’s responsibility. Gaps in the backsplash from walls not being straight are expected. It is the customer’s responsibility to caulk, fill, or cover open gaps as desired. ESP is not responsible for any gaps due to wall construction.
* ESP will not be liable for any damage that may occur to cabinets, tile, or walls when tearing out existing countertops. Any existing tile may be damaged during removal/installation of countertops. There may also be gaps of 1/4" to 1/2" between new countertops and existing tile backsplash. We only tear out what is necessary to complete our installation and we do not do any tile or drywall repair or remodel work. We do offer shimming the countertops to the existing tile for an additional fee.
*Some dust should be expected during your installation. ESP will leave the area in a broom swept condition but some cleanup by the homeowner may be necessary. It is the homeowner’s responsibility to cover any delicate items from dust. It is recommended that the register vents near the work area be covered as well. Dust can get in there as well and later blow around the room.
*This is a construction project. Some minor scrapes, dings, or abrasions to walls and cabinets are to be expected during the installation process. Great care is taken to prevent these situations; however, in some cases it is unavoidable. The homeowner is responsible for any painting or drywall repair required after installation is complete.
* ESP WILL NOT DISCONNECT or RECONNECT any gas or electrical items. ESP WILL NOT RECONNECT any plumbing items. Only a licensed, bonded, and insured professional is recommended to reconnect plumbing, gas, and electrical items.
*ESP installers can disconnect plumbing lines to remove old fixtures, but we are not responsible for leaks due to removal or faulty shut-off valves. If you feel that there is a possibility of leaking due to old or damaged pipes, a plumber should be scheduled to do the removal prior to installation.
*Work area must be clear of other workers during template and installation.
*If faucet information is not received by the time of installation, faucet holes cannot be drilled and there will be a service fee of $200.00 plus mileage to return and drill the holes. The preferred method for drilling faucet holes is in the shop so faucet information at or before the time of template is best.
Warranty
*ESP provides a lifetime warranty on our workmanship. ESP does not cover damage that is a result of abuse or elements out of our control. 24-hour dry time is needed for caulk to fully cure.
*Outdoor kitchens carry no warranty.
Stone Characteristics
* Granite, Marble, Soapstone, Quartzite, Limestone, etc.… are natural stones cut out of different parts of a mountain from different regions and at different times. Quartz is a man-made stone that is manufactured at different times and under different lots/batches.
Therefore, slight variations in color, pattern, density, crystal structure, mineral formation, and texture from slab to slab will occur. Granite and other natural stones may have variations in its finish. This means that when light reflects on it, some areas may appear shiner than others. Different mineral content in those areas contributes to this as well. The quarries or ESP may use epoxy to fill any voids.
Samples used in the selection of your material are only an indication of what the material may look like. You are encouraged to view and approve your chosen material prior to fabrication.
*ESP Products are NOT indestructible and may chip with impact. Stone may have fissures, natural cracks and may have minimal chipping on finished edges. Chipping around undermount sinks and dishwasher areas may occur due to heavy usage. We recommend use of cutting boards, trivets, and hot pads to help protect your countertops.
*Lighter stone colors may darken slightly after sealer is applied.
Stone Field Joints (aka Seams)
* Field joints (seams) of your countertop, if necessary, will be at ESP’S discretion. This will be determined by the actual layout of the job, slab sizes, fragility of the stone and getting the countertops safely into the job site. If you have any questions concerning the location or number of field joints required, it is recommended that you request a layout at the time the order is placed. Requesting a layout after template, could delay installation date.
*If field joints are necessary for your application, the field joints WILL BE VISIBLE and WILL BE FELT. Our installation professionals are trained to use procedures and materials that make the field joints as inconspicuous as possible, but they WILL BE VISIBLE. (Some stone colors have patterns that help seams be less noticeable than others.)
Fields joints on natural stone and quartz may not be flat due to material variations beyond the fabricators control. Some field joints due to color and material flatness may appear better than others.
Field joints may break loose due to natural shifting or movement of your cabinets/ property and can be repaired at a cost of $200.00 when we are in area. Again, you will see and feel the field joints.
Remnant Purchases
*All remnants are sold AS IS which is why they are sold at a discount. Please review pieces closely to determine if there are any scratches, pitting, or discoloration that might exist from the stone being outdoors or being moved around within our facility over a long period of time.
*In the event of damage and/or breakage of a remnant during fabrication, customer may select another remnant at the same price point or pay the difference for a new selection. New full slabs will not be brought in due to remnant damage and/or breakage.
Miscellaneous
*We reserve the right to repair as opposed to replace in the occurrence of cracked or broken stone.
* Plumbing, millwork, and electrical work are not included. Quantity or addition errors are subject to correction. Any deviation or alteration from the above specifications involving extra material and/or labor will be an extra charge over the above estimate and a new estimate will be provided to the customer before fabrication can begin. A restocking fee will apply to cancelled jobs.
* If customer decides to cancel after template or, if applicable, after material is ordered a cancellation fee of up to 30% of the job, will apply.
This covers material return fees, incoming freight, labor, and other expenses incurred to date of cancellation.
